Marathon mediation is a special form of mediation. This type of mediation is often used where a conflict has become entrenched or where proceedings offer no solution. The marathon mediation is a means of getting the parties together around the table and keeping them there for as long as is necessary to reach a final solution. The parties agree that they will try to resolve all of their areas of dispute with the mediator in one day. Sometimes it takes more than one day. First, the mediator talks to each of the parties separately. He studies the file and also holds intensive discussions with the parties’ lawyers and/or experts.
